We do not warrant that the Service will be uninterrupted, error-free, or secure. We do not guarantee that posts will be successfully published to all platforms or that analytics data will be completely accurate.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, NOVATE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, DATA, OR BUSINESS OPPORTUNITIES, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE.
OUR TOTAL LIABILITY FOR ANY CLAIMS ARISING FROM OR RELATED TO THE SERVICE SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE TWELVE (12) MONTHS PRECEDING THE CLAIM.
You agree to indemnify and hold harmless Novate, its officers, directors, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorneys' fees) arising from your use of the Service, your content, or your violation of these Terms.
You may terminate your account at any time by visiting the Account Deletion page. Upon termination, your data will be permanently deleted.
We may suspend or terminate your account at any time for any reason, including but not limited to violation of these Terms. We will make reasonable efforts to notify you before termination, except in cases of serious violations.
Upon termination, your right to use the Service will immediately cease. Sections that by their nature should survive termination will survive, including intellectual property, disclaimers, limitations of liability, and indemnification.
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to its conflict of law provisions.
